Orientação ao Profissional Concursado

Devido a grande procura de informações quanto a questão de ordem salarial, oferecido em concursos públicos, por parte das Prefeituras Municipais em alguns Estados da Federação, esclarecemos que:
Em relação ao Piso Salarial, ou seja, os salários oferecidos pelos entes públicos aos seus servidores (empregados), devem seguir a Lei Orgânica de sua jurisdição, ou seja, órgãos públicos (Prefeituras), não seguem o que determina as Convenções Coletivas Regionais e sim o que esta previsto em Lei Orgânica ou Estatuto do Servidor.
Esclarecemos ainda, que, em se tratando de Piso Salarial, foi elaborado um projeto de Lei, de número 5979/2009, que não teve sua aprovação pelo Senado, por entenderem os digníssimos Senadores, que não era de interesse público, levando ao seu arquivamento.
Informamos que esta sendo reivindicado pelas entidades sindicais, FENAFITO, CNPL – Confederação Nacional das Profissões Liberais, SINFITOS e demais sindicatos ligados  a área de saúde, que seja desarquivado o PL 5979/2009.
Entendemos ser de grande importância para a classe trabalhadora e aprovação deste projeto de Lei, dará dignidade à classe trabalhadora e consequentemente trará benefícios diretos à população.
Quanto à questão da jornada de trabalho, esta, é  definida pela Lei 8856/94 que trata da jornada de trabalho, esta deve ser cumprida por todo e qualquer ente da FEDERAÇÃO, ou seja, a nível FEDERAL, ESTADUAL MUNICIPAL e EMPRESA PRIVADA.

Fixa a Jornada de Trabalho dos Profissionais Fisioterapeuta e Terapeuta Ocupacional.
O PRESIDENTE DA REPÚBLICA Faço saber que o Congresso Nacional decreta e eu sanciono a seguinte lei:

Art. 1º Os profissionais Fisioterapeuta e Terapeuta Ocupacional ficarão sujeitos à prestação máxima de 30 horas semanais de trabalho.
Art. 2º Esta Lei entra em vigor na data de sua publicação.
Art. 3º Revogam-se as disposições em contrário.
Brasília, 1º de março de 1994; 173 º da Independência e 106º da República.

Por fim, esclarecemos aos profissionais que se atentem à jornada de trabalho que é oferecida pelo Concurso Público de seu Município ou Estado, sendo superior à 30h semanais, de imediato, podem fazer uma denúncia junto à FENAFITO ou ao SINFITO de seu Estado, para as devidas providências administrativas junto às Prefeituras ou via denúncia ao Ministério Público do Trabalho de sua jurisdição.
